    Internal Faculty Seminar On the theme “COVID-19 and Force Majeure”

    On 29 June, 2021, Ms. Kajal Choudhary, Assistant Professor, School of Law, IUU presented a seminar titled “COVID-19 and Force Majeure” as part of Internal Faculty Seminar. Ms. Kajal Choudhary discussed as to how the entire world witnessed a situation never seen before i.e., COVID-19. As a consequence of the said ongoing disruption, the performance of countless contract has already and shall inevitably be delayed, or their performance will be rendered impossible. On 29th May 2020 single judge bench of Delhi High Court stated “there is no doubt the COVID-19 is a force majeure event. But every breach or non- performance cannot be justified or excused merely on the ground of COVID-19 as a force majeure. The present seminar throws light on this debate of the pertinent issue as to whether situation created by COVID-19 can be termed as Force Majeure event so as to enable a party to set it up as a reason for excusing the performance of she contractual obligation it also highlighted what other remedy parties are having if the force majeure clause is not there i.e. Doctrine of Frustration. The seminar was primarily based on the issue of the principle of force majeure and its applicability in the extraordinary situation the world is currently facing in the form of COVID- 19. The presentation quite effectively tapped into the dynamic mutation of existing concepts of law under special circumstances.
