Faculty Seminar on “Rights of Accused Person: A Constitutional Perspective”

On 24th July, 2020, Ms. Shalini Saxena, Assistant Professor, School of Law, IUU presented a paper titled “Rights of Accused Person: A Constitutional Perspective” as part of the Faculty Seminar Series.  Ms. Shalini discussed about various rights of accused and their implementation in the present constitutional perspective. The central idea of the presentation was the case analysis of D.K. Basu v. State of West Bengal and Nilabati Behera v. State of Orissa wherein the Supreme Court has remarkably laid down some significant guidelines relating to rights of accused person taking into consideration the gross violations of human rights occurring due to custodial deaths.

Quoting a remarkable precedent set by the Supreme Court of India, the presentation highlighted provisions of compensation to accused in cases of custodial deaths. In her conclusion, Ms. Shalini Saxena discussed the chief impediments to the implementation of these rights and suggested prospective solutions that could be enforced by every state to ensure that due recognition is given to every accused in the light of his Right to Life and Personal Liberty as envisaged in Article 21 of the Constitution of India.
